Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Pozitioning.AI platform ("Service"), operated by Pozitioning.AI ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Service Description

Pozitioning.AI is a brand intelligence platform that monitors how your brand appears across AI-powered search engines and assistants, including ChatGPT, Google AI Overview, Gemini, Perplexity, Claude, and Grok. The Service provides visibility scores, competitor analysis, citation tracking, mention analytics, and actionable recommendations.

2. Account Registration

To use the Service, you must create an account with a valid business email address. You agree to provide accurate information, maintain the security of your password, and accept responsibility for all activity under your account. Consumer email providers (Gmail, Yahoo, Outlook, etc.) are not accepted.

3. Free Trial

New accounts receive a 3-day free trial with full access to the Service. No payment information is required during the trial. After the trial ends, a paid subscription is required to continue accessing project dashboards.

4. Subscription & Billing

  • Subscriptions are billed on a monthly or annual basis through Stripe.
  • You authorise us to charge your payment method on file for the applicable subscription fees.
  • Prices are displayed on the pricing page and may be updated with 30 days' notice.
  • You can manage your subscription, view invoices, and update payment methods through the billing portal.

5. Cancellation & Refunds

  • You may cancel your subscription at any time through the billing portal.
  • Cancellation takes effect at the end of the current billing period. You retain access until then.
  • We do not provide refunds for partial billing periods.
  • If you delete your account, your subscription will be cancelled and all data permanently removed.

6. Usage Limits

Each plan includes a monthly scan allowance. Free plans receive 5 scans per month, Pro plans receive 50, and Agency plans receive 200. Scans reset on the first of each calendar month. Additional usage beyond your plan limit requires an upgrade.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws.
  • Attempt to reverse-engineer, decompile, or extract source code from the Service.
  • Use automated tools (bots, scrapers) to access the Service outside of normal UI or API usage.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Share account credentials with unauthorised third parties.
  • Resell access to the Service without our written consent.

8. Intellectual Property

The Service, including its design, code, algorithms, and branding, is owned by Pozitioning.AI and protected by applicable intellectual property laws. Your scan data and project configurations remain your property. We do not claim ownership of your data.

9. Data & Privacy

Your use of the Service is also governed by our Privacy Policy. We collect and process data as described there. By using the Service, you consent to such processing.

10. Third-Party Services

The Service integrates with third-party AI platforms (OpenAI, Google, Anthropic, Perplexity, xAI) to gather brand intelligence. We are not responsible for the availability, accuracy, or policies of these third-party services. AI-generated responses may change without notice.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that AI engine responses will be accurate, complete, or consistent. Scores and analytics are derived from third-party AI outputs and should be used as directional guidance, not absolute measures.

12. Limitation of Liability

To the maximum extent permitted by law, Pozitioning.AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

13. Termination

We may suspend or terminate your account if you violate these Terms or engage in activity that is harmful to the Service or other users. You may delete your account at any time through the account settings, which will permanently remove all associated data.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of Australia. Any disputes shall be resolved in the courts of New South Wales, Australia.
